Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Momento desktop application, the website mymomento.gg, and any related services (together, the “Service”), operated by the Momento team. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Momento is a capture and review toolkit for competitive esports. The desktop application records gameplay locally, lets you annotate footage with markers and telestrator overlays, and helps you sync clips with your team. The web platform hosts your account, your library and supporting tools such as the TFT Assistant.

We provide the Service on a best-effort basis. Features may evolve, be added or removed. We will give reasonable notice for material changes.

We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.

4. Subscription and billing

Paid plans, where offered, are billed in advance on a recurring basis (monthly or annual) and renew automatically until you cancel. Pricing, included quotas and feature scope are listed on the pricing page at the time of subscription. You may cancel at any time from your dashboard; cancellation takes effect at the end of the current billing period.

Refunds are at our discretion outside of mandatory legal protections (notably the 14-day right of withdrawal for EU consumers). Taxes are added where applicable.

5. Your content

You retain ownership of any content you create, capture, or upload through the Service (clips, screenshots, annotations, notes). You grant us a limited, worldwide, non-exclusive, royalty-free license to host, process and display your content solely to operate the Service for you and the people you share it with.

You are responsible for the content you upload. Do not upload anything you do not have the right to share, anything that infringes intellectual property rights, or anything illegal.

6. Our intellectual property

The Service, including its software, design system, marketing site, brand and documentation, is owned by the Momento team and protected by applicable laws. These Terms grant you no rights to our trademarks or proprietary materials beyond what is necessary to use the Service as intended.

7. Third-party game data and trademarks

The Service integrates with public APIs and assets exposed by game publishers, including Riot Games, Inc. and Valve Corporation, to enrich your gameplay reviews with public match data, ranked information and visual assets.

Momento isn’t endorsed by Riot Games and doesn’t reflect the views or opinions of Riot Games or anyone officially involved in producing or managing Riot Games properties. Riot Games, and all associated properties are trademarks or registered trademarks of Riot Games, Inc.

Similarly, Counter-Strike 2 and related marks are trademarks of Valve Corporation. All other game-related trademarks belong to their respective owners. Use of these names is purely descriptive.

8. Service availability

We aim for high availability but do not guarantee uninterrupted access. The Service is provided “as is” and “as available”. Scheduled maintenance, upstream outages from our infrastructure providers, or outages of third-party APIs (notably Riot Games or Valve) may temporarily affect the Service.

9. Disclaimer of warranties

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement and uninterrupted operation. We do not warrant that the Service will be error-free or that results obtained through it (including competitive insights) will be accurate or fit for any particular use.

10. Limitation of liability

To the maximum extent permitted by law, neither the Momento team nor its contributors will be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, goodwill or data. Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) one hundred euros (€100).

11. Indemnity

You agree to indemnify and hold us harmless from any claim arising out of your breach of these Terms, your misuse of the Service or your violation of any law or third-party right.

12. Termination

You may terminate your account at any time from your dashboard or by emailing us. We may suspend or terminate your account for breach of these Terms, for security reasons, or to comply with legal obligations. Upon termination, sections that by their nature should survive (intellectual property, disclaimers, liability, indemnity, governing law) will continue to apply.

13. Changes to the Terms

We may update these Terms. Material changes are announced by email and within the Service at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

14. Governing law and disputes

These Terms are governed by French law, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts in Paris, France, save for mandatory consumer protection rules that grant you the right to seize the courts of your habitual residence.
